C Magazine Auction

By bidding at auction, bidders are bound by the Conditions of Sale and Terms of Bidding, as amended by any announcements, lot descriptions or posted notices, which together form the contract of sale between the successful bidder (Buyer), and C Magazine (Auctioneer).

Terms of Bidding

All bidders must be registered to bid and provide a valid credit card number. All sales are final. No purchase can be returned, refunded or exchanged. Bidders are legally responsible for all bids that they have placed, even if a bid has been placed in error. The Buyer immediately assumes full risk and responsibility for the lot. When you register to bid, you are agreeing to these rules. C Magazine is not responsible for technical or human errors, or failures to execute bids.

Conditions of Sale

Catalogue descriptions posted at auction.cmagazine.com are subject to change until the auction opens. C Magazine reserves the right to withdraw any work of art at any time before the actual sale begins.

Each lot lists an estimated market value obtained from sources C Magazine believes reliable. This estimated value is intended as a guide to assist attendees in their bidding. The starting bid represents a percentage of the estimate (typically 50-60%), and is the minimum the piece can be sold for. No representation or warranty on the resale value of a work being auctioned is made or implied.

All artworks are in excellent condition unless otherwise stated. Sizes are approximate. Descriptions or photographs of lots are not warranties and each lot is sold as is. If the piece is not signed and dated, C Magazine can request a certificate of authentication from the artist.

Bidding Online – Silent and Live Auction Advance Bidding

Bidding Online: To bid online create an account at auction.cmagazine.com. Click on “sign up” or “log in” in the top menu, or initiate a bid on a lot. You must save a credit card in the account to bid online.

Automated Bid-for-Me bids are a great tool if you are not sure if you will be online when the auction is ending or if you’d like to set a specific budget, enter the maximum amount you would be willing to pay for the item and let the software do the bidding for you.

Note: Automated bids that have not yet been executed when online advance bidding ends on Live Auction lots (Tuesday, September 20, 12 PM ET) cannot be transferred to the in-person paddle auction. We will email Live Auction advance bidders to ask if they want to submit an absentee bid (also known as a proxy bid) for the live paddle auction.

Bidding at the Live Auction: A credit card will be required to secure a paddle. Save time when you arrive by saving your credit card when you buy a ticket online. Live Auction purchases will not be charged to your card without your signoff at the event.

Be sure to bring your cell phone to the event to interact with your account and bid in the online Silent Auction that closes at 9:30 pm EDT, after the in-person Live Auction.

Bidding for the in-person live paddle auction will begin where the advance online bidding left off. Lots are listed in the numeric order by which they will be auctioned.

Absentee bids (also known as a proxy bid) are a great tool for those who cannot attend the in-person auction. Submit your absentee bid by email at auction@cmagazine.com before Tuesday, September 20, 12 PM EDT.

Absentee bids will be executed on behalf of the bidder at the lowest price, up to your bid limit in Canadian dollars, taking into account any reserve and other bidders. In the case of identical bids, the earliest received will take precedence. C Magazine is not responsible for errors or failures to execute absentee bids.

Winning Bids and Payment

The Silent Auction buyer will be the highest bidder for the lot, according to the Trellis bidding software. Silent Online Lots close on Tuesday, September 20, 2022 at precisely 9:30pm EDT. Silent Auction purchases will be charged automatically to the credit card saved in the account.

The Live Auction buyer will be the highest bidder for the lot, according to the auctioneer. Live Auction purchases made in-person will be signed off by the buyer and charged to the credit card registered at the event, unless an alternate payment method is arranged.

Successful absentee bidders will be notified with 24 hours of the auction’s conclusion and purchases will be charged to your credit card, unless an alternate payment method is arranged.

If an autopayment fails, successful bidders will be invoiced by email, and payment is due within 48 hours of receipt of the invoice. All buyers must pay for their purchases before receiving the artwork, unless otherwise arranged with Kate Monro, the authorized representative of C Magazine at auction@cmagazine.com

ALL PRICES IN CANADIAN FUNDS. No HST/ sales tax is applicable. A buyer’s premium of 8% of the successful bid price of each lot is paid by the buyer as part of the total purchase price.

Tax Receipts for Art Purchases

For artworks that sell for more than 100% of the estimated value, the purchaser will be issued a charitable tax receipt for the difference between the estimate and selling price.

Shipping, Delivery, Pick-Up

C Magazine will undertake packing for pick-up of both Silent and Live lots at the Live Auction event, at 72 Perth Avenue, after the closing of the auctions on September 20, and on September 21, 12:00-5:00 pm.

Reliable pre-auction estimates of long-distance shipping and crating costs of lots offered in this sale may be obtained from: Museumpros Art Services, Matt Meagher (1-416-588-0568). Unless the purchaser makes alternate arrangements for shipping, delivery, or pickup, Museumpros will provide shipping or delivery of the work, payable by the purchaser directly to Museumpros.

The auctioneer will email out of town Buyers and provide them with shipping quotes (FedEX, Canada Post, or a quote from Museumpros), as applicable. C Magazine is not responsible for these services and is not liable for providing this information. The Buyer must designate the services of the independent shipper, and be responsible for declared value, added insurance, limits of liability and insurance, packing or crating for shipping, and shipping expenses.

Due to Ontario Government guidelines concerning Covid-19, we may not be able to arrange immediate shipping, delivery or pickup for every purchase. We will store purchases free of charge at an insured, secured location if there are any existing restrictions on the planned auction date of Tuesday, September 20, 2022.

The C Magazine Auction is composed of both an Online Auction and a Live Auction. Silent Auction artworks within the Online Auction will be bid upon exclusively online. Items for the Silent Auction are each labelled “Silent.” Live Auction artworks within the Online Auction will accept advanced bids online, and final bids at the live event on 20 September 2022. Items for the Live Auction are each labelled “Live.”

ONLINE AUCTION
Online bidding for all artworks opens Friday, 9 September at 6 pm EDT.

Silent Auction Lots #01-40
Bidding for Silent Auction artworks will close on Tuesday, 20 September at 9:30 pm EDT.

Live Auction Lots #41-62
Advanced Bidding for Live Auction artworks will end online on Tuesday, 20 September at 12 pm EDT, to resume in person.

LIVE AUCTION
Bidding on the Live Auction artworks will resume in-person at 72 Perth Avenue in Toronto on Tuesday, 20 September at 7 pm EDT for auction ticket holders, absentee, and phone-in bidders.

If you wish to bid remotely on the Live Auction works, we would be pleased to provide a dedicated telephone bidder, or you can register a confidential Absentee Bid, where the Auctioneer will execute bids on your behalf during the Live Auction.
